General terms and conditions of sale

ARTICLE 1

Any reservation made with Cab-Bel-Air implies unreserved acceptance of these general conditions of sale.

ARTICLE 2 – RESERVATIONS

All services must be the subject of a reservation confirmed in writing. Reservations can be made on our dedicated page  (https://cabbelair.way-plan.com/en/demande/ajout/) by phone at +33 766 29 00 69. An email confirming our availability will then be sent by our services. Any reservation for a service must be made no later than 24 hours before the start of the service. It must be carried out by the client or by a duly authorized agent. Any reservation must imperatively mention the following elements: name and contact details of the customer (address, email, telephone), address of the pick-up location and address of the arrival location for transfers, the desired duration for the provision, date and start time of the service, number of passengers and number of baggages. A booking confirmation must be returned to us, by email or by post, marked “Good for agreement”, and signed by the client.

ARTICLE 3 – SERVICE

The service is only valid once. The service begins at the vehicle’s parking place, on the day and time fixed in the contract previously drawn up between the parties. It ends on the day and at the time of return of the vehicle to its place of departure. In the event of a customer delay, the driver will wait 15 minutes at the pick-up location. After this period Cab-Bel-Air will consider the canceled service. This will be invoiced to the customer and will not give rise to any refund. If it turns out that the customer is not present at the meeting place, the service will be definitively lost, due by the latter and give no right to reimbursement. If the customer cannot find the driver, he must immediately call Cab-Bel-Air to avoid being billed for the full amount of the service. Respect and proper use of equipment is essential. Any deterioration of the equipment and any damage caused inside the vehicle will be charged to the customer and will be invoiced to him. Smoking is strictly prohibited inside the vehicle. It is compulsory to wear a seatbelt at the front and at the rear of the vehicle. Animals are not allowed in vehicles, except in a cage or bag provided for this purpose. Cab-Bel-Air is in no way responsible for items left in vehicles or elsewhere during the service. In no case may the customer demand that the driver exceed the authorized speed limit or commit any traffic violation. More generally, the driver reserves the right to refuse any instructions and / or requests from the client that he would consider as being such as to compromise the safety of the occupants of the vehicle and of other road users.

Our drivers are real professionals, their responsibility being engaged, they are instructed to respect and ensure respect for the laws in force.

Cab-Bel-Air reserves the right to interrupt any service on the spot, in the event that the customer comes to behave in a way that jeopardizes the safety of the driver, the rented vehicle or other road users. The service will then be invoiced in full to the customer.

Customers who are too drunk or insulting to the driver will in no case be allowed to board the vehicles. The service will then be invoiced in full to the customer.

The volume of baggage transported is proportional to the capacity of the vehicle. They remain for the entire service under the responsibility of the persons transported.

Any modification of the journey by the customer or by his principal, may generate supplements which will be invoiced to him.

The service provided by Cab-Bel-Air as regulated by articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the Tourism Code, consists of updating provision to the customer of a vehicle, accompanied by the services of a driver.

The following are thus included in the service:

  • the vehicle made available to the customer;
  • the provision of a driver who speaks at least French;
  • professional insurance for passengers transported against payment, the kilometers traveled, vehicle maintenance, fuel and the duration determined when booking the service the transport of the customer’s luggage, within the limits of the possibilities of the trunk of the vehicle.

The following are not included in the Service:

  • the cost of tolls
  • the cost of parking lots and more generally of all parking places;
  • entrance fees to sites (museums, theaters, castles, stadium or others);
  • entrance fees to public places

ARTICLE 4 – PRICE

The prices established by our simulator are given as an indication and can be modified according to the desired schedules. To confirm this rate, it is recommended to send a reservation request. Cab-Bel-Air will confirm all the details of this request and in particular the price of the service. Our prices are inclusive of VAT, and are expressed in Euros (€). The applicable VAT rate for transfers is 10%. The applicable VAT rate for hourly deliveries is 20%. The transfer rate applies to direct travel, without stop, without stopover, from the place of pick-up to the place of arrival previously established in the contract.

The rates are applicable for operations not exceeding 2 vehicles of the same category. Beyond that, Cab-Bel-Air reserves the right to increase its prices according to the number of vehicles desired. Prices are per vehicle, regardless of the number of people transported (up to 3 for sedans and up to 6 for minivans). For the provision, any hour started is due. Any additional kilometer to the package established by the contract will be invoiced at € 2 incl. Tax / km.

Any additional hour to the package established by the contract will be invoiced at € 120 including tax / hour. For trips planned over several days, the following flat rates will be charged to the customer:

  • meal = 30 € TTC
  • hotel night + breakfast = 200 € TTC

Our rates include:

  • VAT
  • the vehicle made available to the customer;
  • the provision of a driver who speaks at least French;
  • professional insurance for passengers transported for a fee, the kilometers traveled, vehicle maintenance, fuel and the duration determined when booking the service
  • the transport of the customer’s luggage, within the limits of the possibilities of the vehicle trunk.
  • the provision on board of service vehicles (WIFI, cold drinks, refreshing wipes and or tissues, phone chargers)
  • the cost of tolls.

Our rates do not include:

  • the cost of parking lots and more generally of all parking places;
  • entrance fees to sites (museums, theaters, castles, stadium or other) except specific excursion packages;
  • entrance fees to public places;
  • the cost of meals and accommodation for the driver for a trip over several days, except specific excursion packages

ARTICLE 5 – REGULATIONS

Our services are payable in cash, in euros, on board the vehicle, when the customer is picked up, except for our “Large Account” and Partner customers for whom periodic invoicing is established, and for prepaid services.We accept payment by bank transfer, cash and bank card (Visa, Mastercard, American Express, etc.).For our “Large Account” customers and our partners, the services are payable in cash upon receipt of an invoice unless there is a specific contractual agreement.
No discount is granted for payment on a date prior to the service.In all cases, the client signing the reservation is solely responsible for paying for the service in the event of user default.Any additional service, any exceedance of kilometer or duration, will be invoiced in accordance with the price indicated on the order from any hour started is due in full. 
For wedding or excursion packages, and generally any transport lasting more than four hours or more than 100 km, the reservation only becomes firm after payment of a refundable deposit according to the General Terms and Conditions, deposit at least equal to 50% of the cost of the service.

ARTICLE 6 – CANCELLATION

a) TRANSFER RESERVATION (ONE WAY less than 100 km, less than three hours ) (from point A to point B): Cancellations are free up to 60 minutes before one-way trips, for the pick-up location charge. In all other cases, the total price of the journey will be invoiced.

b) TIMETABLE RESERVATIONS, TRANSFERS, multiple transfers, transfer of more than 100 km and less than 400 km and reservations of less than 4 hours: Cancellation is free if made at least 24 hours before the scheduled pick-up time. If a cancellation is made with less than 24 hours notice but there is more than two hours between cancellation and pickup, only 50% of the reservation price will be charged. If a cancellation is made with less than 2 hours notice, the total price of the trip will be charged.

C) Reservation for more than 4 hours, or more than 100 km, or Tours, excursions, Visits, Multi transfers including entrance tickets (Castles, museums, exhibitions, parks, etc.), services including wedding ceremony, baptism…  reservations including table reservations, restaurants, hotels, etc: If a cancellation is made with less than 8 DAYS notice but there is more than 48 hours between cancellation and pickup, only 50% of the reservation price will be charged – If a cancellation is made with less than 48 hours notice, the total price of the trip will be charged. The service will be considered due and billed to the customer. In the absence of the client, the service will be considered due and invoiced.

Beyond a waiting period of 15 minutes at the pick-up location, the service will be considered due and billed to the customer. In the absence of the client, the service will be considered due and invoiced.

ARTICLE 7 – LIMITATIONS OF LIABILITY

Cab-Bel-Air cannot in any case be held responsible for delays on rail and air traffic. Cab-Bel-Air cannot in any case be held responsible for delays due to road traffic beyond its control: road blocked, bridge prohibited to traffic, traffic jams, flooded road, demonstration, weather conditions, interventions by the police forces, firefighters or customs, etc … (non-exhaustive list). Cab-Bel-Air can in no way be held responsible for delays directly resulting from an initial delay by the client, or the need to make a journey, at the request of the client, in a manifestly too short time. In case of impossibility, immobilization of the vehicle due to a mechanical failure, an accident or damage (theft, damage), Cab-Bel-Air will endeavor to ensure the continuity of the route, either with one of these vehicles, either with a vehicle chartered to another company.

ARTICLE 8 – INSURANCE

Cab-Bel-Air’s liability is limited to the clauses of our insurance contract. Our vehicles are insured for the transport of people and our travelers for all bodily injury with our insurer. This insurance also covers professional civil liability, in accordance with French regulations in force, in application of article L. 3120-4 of the Transport Code. The principal will be able to take out additional insurance at his expense covering cancellation costs, repatriation costs or baggage transported.

ARTICLE 9 – PERSONAL DATA

Cab-Bel-Air is committed to respecting the privacy of its customers.Cab-Bel-Air undertakes to respect the confidentiality of personal data collected on its website in accordance with French Data Protection Act n ° 78-17 of January 6, 1978. As such, Cab-Bel-Air undertakes not to disclose to third parties external to its network of drivers, the information communicated by the customer on its website and to use it only for the processing of his reservation. The customer can exercise a right of access to his file and a right to rectify or delete information concerning him by sending his request to Cab-Bel-Air Customer Service. 

ARTICLE 10 – DISPUTES

Any complaint must be notified in writing and by registered letter to the attention of Customer Service, within a maximum period of 8 days. After this period, no claim will be successful.Subject to legal provisions, any dispute is, by express agreement, the exclusive jurisdiction of the Commercial Court of Nanterre (92).
